Agreement to Terms

• "Lead" refers to contact information and project details submitted through our Platform
• "Services" refers to our lead generation and referral services only, not actual contracting work

Platform Service Description

Toronto Home Reno operates exclusively as a lead generation and referral platform. Our sole function is to:

• Collect contact information and project details from potential customers
• Transmit this information to independent contractors in our network
• Facilitate initial communication between customers and contractors

We explicitly DO NOT:

• Perform any physical renovation, repair, or home improvement work
• Employ, hire, supervise, or control any contractors
• Guarantee contractor response, quality, pricing, or availability
• Act as a contractor, general contractor, or home improvement company
• Provide any warranties or guarantees regarding contractor services

Use of Website

Permitted Use

You may use our website for lawful purposes only and in accordance with these Terms. You agree not to:

• Use the website in any way that violates any applicable law or regulation
• Transmit any harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the website
• Impersonate any person or entity
• Collect or harvest information from the website

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Toronto Home Reno and is protected by copyright, trademark, and other intellectual property laws. Independent Contractor Relationship

All contractors in our network are independent businesses and are not employees, agents, or representatives of Toronto Home Reno. The relationship between you and any contractor is entirely separate from our Platform. You acknowledge and agree that:

• Contractors operate under their own business licenses and insurance
• We do not control contractor pricing, scheduling, or work methods
• Contractors make their own decisions about accepting or declining projects
• All agreements regarding work are directly between you and the contractor
• We have no authority to bind contractors to any terms or obligations
• Contractors are solely responsible for their own actions and work

No Guarantees or Warranties

Toronto Home Reno provides this Platform on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. We explicitly disclaim all warranties, express or implied, including but not limited to:

• No Guarantee of Contractor Contact: We do not guarantee that any contractor will contact you or accept your project
• No Quality Guarantees: We make no representations about contractor skill, experience, or work quality
• No Licensing or Insurance Verification: We do not verify contractor licenses, insurance, bonding, or qualifications
• No Price Guarantees: We have no control over or responsibility for contractor pricing
• No Completion Guarantees: We do not guarantee project completion, timelines, or satisfaction
• No Code Compliance: We make no warranties regarding building code compliance or permit requirements

Data Submission and Consent

By submitting your contact information and project details through our Platform, you expressly consent to:

• Toronto Home Reno collecting and storing your personal information
• Sharing your information with independent contractors in our network
• Contractors contacting you directly via phone, email, or text
• Receiving follow-up communications from our Platform

You represent that all information you provide is accurate and that you have authority to submit the information. You are responsible for updating us if your contact information changes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TORONTO HOME RENO SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, INJURIES, OR CLAIMS ARISING FROM OR RELATED TO:

• Any services performed or not performed by contractors
• Quality, safety, timeliness, or completeness of contractor work
• Contractor pricing, estimates, or billing practices
• Property damage caused by contractors or their work
• Personal injury or death caused by contractors
• Financial losses related to contractor services
• Contractor fraud, theft, negligence, or misconduct
• Breach of contract by contractors
• Contractor license, insurance, or regulatory violations
• Building code violations or permit issues
• Disputes between you and any contractor
• Failure of contractors to respond or accept projects
• Inaccuracy of information provided by contractors

IN NO EVENT SHALL TORONTO HOME RENO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our maximum aggregate liability for any claims arising from your use of our Platform shall not exceed $100 CAD, regardless of the legal theory of liability.

Your Responsibility for Due Diligence

YOU ARE SOLELY RESPONSIBLE FOR:

• Verifying contractor credentials, licenses, and insurance before hiring
• Checking contractor references and reviews
• Obtaining and comparing multiple quotes
• Reviewing and negotiating contracts with contractors
• Ensuring contractors obtain necessary building permits
• Inspecting work performed by contractors
• Making all payment decisions and arrangements
• Resolving any disputes directly with contractors
• Taking legal action against contractors if necessary
• Ensuring compliance with all applicable laws and regulations

TORONTO HOME RENO STRONGLY RECOMMENDS THAT YOU:

• Always verify contractor licensing with provincial authorities
• Confirm contractors carry adequate liability insurance and WSIB coverage
• Get all agreements in writing before work begins
• Never pay in full before work is completed to your satisfaction
• Check that contractors obtain required permits before starting work

Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Dispute Resolution

In the event of a dispute:

• We encourage direct communication to resolve issues
• Disputes may be subject to mediation before legal action
• Legal disputes will be governed by the laws of Ontario, Canada
• Jurisdiction will be in the courts of Toronto, Ontario

Indemnification

You agree to indemnify, defend, and hold harmless Toronto Home Reno, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and costs) arising from or related to:

• Your use of our Platform or services
• Your relationship with any contractor
• Any work performed or not performed by contractors
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Any inaccurate or misleading information you provide
• Any disputes between you and contractors

This indemnification obligation will survive termination of these Terms and your use of our Platform.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with any service agreement and our Privacy Policy, constitute the entire agreement between you and Toronto Home Reno regarding the use of our services.
